As you continue your aviation journey, the probability of incidents involving rented, borrowed, or owned aircraft rises. Incorporating aircraft insurance into your aviation budget is a necessary item to protect you and your family financially.
As a renter:
Many individuals are shocked to discover that they may not be personally covered under their flight school or FBO’s insurance policy. The insurer will provide coverage to the business itself during a claim; however, they could go after the pilot liable for damage to recoup their losses. This most commonly occurs in a rented aircraft when a CFI is not on board, for example a solo cross-country flight. A non-owned (often called a renters) insurance policy provides a defense if you were held accountable for damage to an aircraft that did not belong to you.
Non-owned coverage is secondary to the primary policy held by the aircraft owner. If there is damage to the aircraft, the primary policy will ensure the owner is made whole; then your non-owned policy comes into play if you were deemed at fault. Your non-owned policy will not provide coverage for wear and tear or mechanical breakdown.
Non-owned premiums are based on the limits purchased, not pilot experience. Therefore, an ATP and a student pilot purchasing the same insurance limits will have the same premium.
As an aircraft owner:
While there is no federal law mandating insurance coverage for general aviation aircraft, many airports require tenants to carry at least liability coverage. An aircraft insurance policy is typically broken down into three main limits: bodily injury and property damage, medical payments, and physical damage coverage.
1. Bodily Injury and Property Damage: The standard limit for bodily injury and property damage is $1,000,000. Higher limits may be available based on your underwriting criteria. Keep in mind, these payments are for third-party damages only and are not a substitute for your personal health insurance.
2. Medical Payments: These are no-fault payments available to an injured individual, which may include the pilot. They are intended for emergency and necessary expenses, regardless of aircraft owner responsibility.
3. Physical Damage (Hull) Coverage: Often comprising the bulk of the insurance premium, physical damage coverage applies to the aircraft itself. Most aircraft insurance policies use stated value policies, so in the event of a total loss, you would receive a check for the aircraft value listed on the policy, minus any deductibles.
Unlike car insurance, aircraft insurance deductibles rarely affect the policy premium. Instead, the premium is primarily based on the pilot’s flying history, the aircraft’s loss experience, and its hull value. Generally, the more experienced you are with a particular type of aircraft, the lower your premium will be.
For example, consider a pilot with no tailwheel experience; they would pay a higher premium for their Citabria insurance compared to a pilot who has logged 500 hours of tailwheel time. Investing in gaining experience combined with an incident-free flying history can significantly lower insurance costs.
As a business owner:
Insurance is one of the first items your airport will confirm before allowing the doors of your aviation business to open. General liability insurance can encompass several key areas of your operation.
1. Premises Liability: Often referred to as basic slip and fall coverage, premises liability protects you from claims due to accidents that occur on your property.
2. Products and Completed Operations Coverage: If you provide fuel services or maintenance, your general liability insurance will include this coverage. For example, if an accident occurs and results in a suit involving an aircraft you had maintained, this coverage provides your defense.
3. Hangarkeepers Liability: Available as an option within general liability policies, this coverage provides protection against physical damage to aircraft that you do not own but are in your custody for storage or maintenance.
Each of these coverage areas ensures that your aviation business is protected against a variety of potential risks, giving you the peace of mind to operate smoothly and safely. Other policies to consider for your aviation business are workers compensation, hangar and contents, and cyber liability.
While these insurance policies provide essential financial protection, we cannot predict what will happen on a flight or at your place of business. The best way to protect ourselves is to hold ourselves to a standard of operating procedures in the air and in the workplace. Insurance will not prevent an accident from occurring, but it can ease a potentially disastrous financial burden in the case of a claim.
